The Florida Southern District Court has decreed:

ORDER OF PERMANENT INJUNCTION
THIS CAUSE is before the Court upon remand by the United States Court of Appeals for the Eleventh Circuit. Pursuant to the Eleventh Circuit mandate [DE-995], remanding this case to this Court with instructions to enter a nationwide permanent injunction pursuant to the Satellite Home Viewer Act of 1988, as amended by the Satellite Home Viewer Improvement Act of 1999, it is

ORDERED, ADJUDGED AND DECREED that, effective December 1, 2006, Defendants Echostar Communications Corporation (d/b/a DISH Network), EchoStar Satellite Corporation, Satellite Communications Operating Corporation and DirectSat Corporation (collectively “Echostar”), their officers, agents, servants, employees, and attorneys, and those persons in active concert or participation with Echostar are hereby PERMANENTLY ENJOINED AND RESTRAINED from the secondary transmission, pursuant to the statutory license set forth in Section 119, Title 17, United States Code, of a performance or display of a word embodied in a primary transmission of any network station affiliated with ABC, Inc., CBS Broadcasting, Inc., Fox Broadcasting Company, or National Broadcasting Co. For the purposes of this permanent injunction, the terms “secondary transmission,” “primary transmission,” “primary network station,” and “network station” shall have the meanings given those terms in Section 119, Title 17, United States Code.

DONE AND ORDERED in Chambers at Fort Lauderdale, Broward County, Florida, this 20th day of October, 2006.


Unless Dish can win an appeal from a higher court, Dish Distants are history as of Dec.1, 2006.

Thanks for the update. Sounds like a lot of folks are going to be without networks. Here are just t a few alternative solutions. Digital C-band has the Denver 8 and Star Choice has the Spokane and Buffalo US Network stations in standard definition and simulcasts Seattle and Detroit in both standard and high definition.


Being a snowbird there is nothing better than being able to watch your hometown stations when you are away. l'm in seventh heaven here in Ajijic. I can listen to my favorite radio station, 89.5 CIOC, and watch my favorite TV stations, the same ones I have always watched when up North from Seattle (CH 4,5,7,9, & 13), to Vancouver (Ch2, 8,+ ) to Victoria (ch 6) and I can do this with a much smaller satellite dish than required for C Band or DISH network. What system is that? Star Choice, of course

You know, sometimes I have the thought that it's just better to live obliviously (is that a word?) to the world and not knowing or careing what is going on more than two miles from my front gate. OOHHH; how peaceful that could be.

What does it mean that the Dish Distants will go away??

Well, if you brought your system from the US, you are getting your networks in either one of two ways. 1. Your service address is in a "white area"-meaning an area not served by any locals- and are subscribing to the national networks. These are the people that will be affected and lose their subscriptions. 2. Your service address is in an area served by either LA, Denver, Chicago, Atlanta, or NY. In this case, you are getting the local networks that happen to be broadcast on ConUS transponders from Dish. This means you will NOT be affected unless, as Pete as speculated, they change these to spot beam transponders.

If you subscribed after you moved to Mexico from one of the local dealers, I don't really know which of the above the dealers use to get the networks. Perhaps Pete can tell us.

Tim: I wish I had an answer to your question. All one can do is check with his local satellite dealer and see if he can help you. Just remember to shop around. Some dealers charge up to twice as much as their competition.

What about the third group, RVers who have an affidavit on file with Dish and are allowed to subscribe to any/all of the 4 national feeds? We've switched to StarChoice but we used to be in that group and there are still a lot of people who do just that. It's available to RVers and truckers who file the affidavit that the receiver is in a liveaboard vehicle and attach a copy of the registration.

Current interpretation of the injunction does not seem to allow for this group. It appears to be a blanket injunction to prevent broadcasting these networks for any reason. What you read is what you get- or won't get.

Read the attached explanation for the injunction. I see no exception, but I am not a lawyer.

Not far from Marfa from which I subscribed when living in SMA. I would see if the Dishnetwork supplier could expedite your moving to LA to at least prolong the agony before that too gets shutdown by switching completely to spot beams.

If you haven't contacted your local DishNetwork supplier regarding your networks, I suggest you do so now. Your service address needs to be in LA, Chicago, NY, Atlanta, or Denver to continue receiving the US national networks. Dish has started, as of Nov. 1st, to randomly select accounts receiving Distants and shutting them down. For those of you that brought your system when moving, YOU must call Dish from a US number-like VoIP-to change your service address if you are receiving your networks via the distant waiver system. You will have to "move" to one of the above cities.
