moratorium on wells?

Can't Post | Private Reply
Does anyone know about the extent of well moratariums, ie) all states? some states? or which states...and are there any minimum land sizes to which might enable one to qualify for a new well in the country? Also, any links to info on the well moratorium would be greatly appreciated. Muchos gracias

I know how frustrating it can be when one cannot find the answer to a question so I thought I would look for you since I do not know the answer myself.

You may want to take a look at the LEY DE AGUAS NACIONALES or the National Water Law.

It has some information on wells and rights associated with them on the national level.

There are also state laws like this one for Mexico DF .

If you are interested in a particular state or area search Google “ Ley de Agua {state or city name}

Here you can find a list of companies that specialise in water wells in Mexico. They may have the information you are looking for

Hope this helps

I think the answer is "this is Mexico" and who's going to know you have a well out in the country. There may be some parts of Mexico with water problems but there was no mention of permits when I dug my well a month ago on the west coast

I have a Mexican friend who owns a ranch and he mentioned something about this a year or so ago. He said that he was going to try and drill as many wells as he possibly could as soon as possible because there was going to be a change in the law that would require him to obtain permits to do so even on his own land. I didnt investigate it any further because it wasnt an issue for me at the time.

It is my understating that a permit has always been required to drill a well.
The water belongs to the government, not to the land owner.

Youre probably right Rolly. I didnt get into it too much with him. It is possible that the law was always there, but that they simply werent enforcing it in his area. I also remember him mentioning that there was a difference between a personal use well and an industrial well which he said did require a permit in his area. The difference between them had to do with the size and the depth I believe.

Nevertheless, with greasy palms all of this permit nonsense gets thrown out the window anyways. Business as usual.
