IMSS with a contractor/architect

Can't Post | Private Reply
I'm ready to start a major addition. I brought up IMSS to our contractor. He insists he hasn't paid it before and doesn't want to start now. He's done quite a few projects around town including new construction.
A friend of mine says that others have used an attorney to make a contract stating that the contractor is paying it and have him sign off each week - and pay him only. I'm worried about this. I'd prefer to just pay it and not worry, but the contractor has been very insistent about this.
Has anyone had any experiences? Any advice much appreciated.

I understand your need to feel protected and to protect the builders etc. but if there is anything you can do to avoid being involved with IMSS - then do it! We did a major remodel in a northern (not NOB) state a few years ago and feeling cautious, insisted on buying our crew IMSS - it was a nightmare. I think that you might want to go to Rolly's site and read up on his remodel where he talks about IMSS - www.rollybrook.com. He may chime in here - Rolly - anything to add to this?

Robert, my first reaction is to say "Get another contractor." It is a very dangerous crap shoot to do any major work without covering the crew with IMSS. Three major reasons: 1) If IMSS catches you (and they do), it will cost you more than if you had signed up in the first place. 2) If a worker is injured on the job, it is likely you will have to pay the doctor/hospital and continue him on the payroll while he is laid up. 3) It's the right thing to do for the workers. I agree that dealing with IMSS can be a major headache, but not doing so has the potential of being worse.

Thanks to both of you. I want to be able to sleep. The thing that pops in my mind is one of these guys plopping off the second story. I can see that maybe contractually I may have a way out, but not if someone gets hurt.
I'd hate to look for another contractor at this point. But I can't see any other way whereby I could sleep. Thanks again.
