Help Please - Cancel Vehicle Importation Permit

I'm looking for advice/assistance that anyone can give me regarding the procedure to get a cancellation of a vehicle importation permit.<p>Here are a few details of our situation.<p>In February 2002 we obtained a 180 day vehicle importation permit at the Nogales border crossing. In March 2002, on our way home, our vehicle was destroyed by fire on the road between Guaymas and Hermosilla. The vehicle was taken to Guaymas and we were given police documents stating the vehicle was totalled. We left the vehicle in Guaymas. <p>Because of the situation, and how we departed Mexico, we did not go though Nogales customs when we departed Mexico. <p>Ever since then we have been trying to obtain a cancellation of the vehicle importation permit. We've been told the only way to do this is to physically return to Nogales customs. We live a long ways away from Nogales and are tying to find another way to handle this.<p>
I realize this is not a legal forum... but any advice is appreciated. I'm sure there must be other people out there with a 'similar' situation. Does anyone have any advice on how to obtain the cancellation.<p>Thank you for your time.<p>Karrie<p>

I would take the papers the police gave you and when you cross the border the next time, be ready to bring out the papers. You'll have to present the papers to a border officer. That with some verbal explanation, you should have no problem. Don't offer a bribe. At the 21K office outside of Nogales it's very obvious they are looking to bust someone offering a bribe. I have been through this process before. It's no big deal. What happened to me was that I turned in my papers correctly, before I left Mexico, but the computer system had me as still having the car in Mexico. I told them they had made a mistake and that either the computer system had failed or someone input the wrong data. After about 20 minutes, the new form was initialed and I was on my way. Even though the computer system is in place now, it is not a perfect system. The border folks know this fact. Therefore, things revert back to normal Mexican business....everything is negoitable. Be patient, insistent and muy amable.

That with some verbal explanation, you should have no problem. <p>Although this sounds like a reasonable approach, personally I'd hate to start off another trip with a gamble that things will work out amicably, and have the trip damaged or compromised if things don't. With that in mind, Karrie have you tried writing the Mexican Embassy in Washington DC, or at least your local Mexican Consulate? Although in this day and age we often opt for the instant gratification of email or telephone calls, quite often a polite letter explaining the situation, with supporting documentation (copies of the original permit and the police report) will get results where more throw-away means of communication fail.<p>The Mexican Embassy in Washington DC's address is:

Thank your for your replies. I've called several of the Mexican Consulates in the states... and I've spoke with the US Consulate in Tijuana & Nogales. Everyone keeps saying that the only place this can be resolved is at the same border crossing where we obtained the permit. And that it can't be handled via phone, fax or email.<p>I will try and contact the Mexican Embassy in Washington DC though. Thank you for that advice.<p>I asked the US Consulate in Nogales if they would assist me with resolving this... and the answer was if Customs denies the cancellation permit then they will send them a letter. But that they would only do that once we have gone back into Nogales to try and get the permit cancelled and they denied it.<p>I guess part of the problem is that, not only is the vehicle still in Mexico, (will remain there too) the original importation permit was burnt with the vehicle.<p>I will be in Mazatlan & PV within the next two weeks. Does anyone know if and where I might have a chance of getting the permit cancelled at either of those cities? Or... do you feel it's true.. that the only way we are going to resolve this is to physically return to Nogales?<p>Thank You,<p>Karrie

I am confused, because, we have taken two vehicles to Mexico and left them and they have been legalized in Mexico. Also, the same thing happened to us, our van caught on fire and burned. Our permit was in the van. We got the papers from the local police. On our way out, showed the papers about the van, along with pictures. We have never been asked about the other vehicles that we took in to Mexico. Maybe it is better that I didn't even know that you had to prove that you broght the vehicle back. Nobody has ever asked about any of the vehicles.<p>: Thank your for your replies. When you show them the papers you have and obtain a new permit for the next car you are going to bring in, the other car will automatically be cancelled. I found the authorities at the 21K stop to be very accomodating. To think you are going to get a response from Washington DC is a big JOKE in my opinion. You can also get a notarized document in the US stating that your car was burned and left in wherever. Type it out yourself and have your signature notarized. What about your US insurance? Any paperwork that looks official will help you.

You might also consider engaging the services of an abogado or licensiado, who is experienced in dealing with Aduana, to assist you, if you want to take care of this now, and not wait until the next time you cross the border with another vehicle. <p>Causales para no efectuar el retorno del vehículo importado temporalmente<p>Deberá presentar un escrito dirigido al Administrador de la Aduana por la que ingresó el vehículo, manifestando las características del mismo, número de holograma, fecha del ingreso y vencimiento del permiso de importación temporal, anexando los supuestos que a continuación se indican::<p>a) Robo del vehículo importado temporalmente<p>1) Copia certificada del acta de robo presentada ante la Agencia del Ministerio Público que corresponda al lugar donde ocurrió el robo.<p>2) Documentación que compruebe que se pagaron los impuestos al comercio exterior y el cumplimiento de las obligaciones en materia de regulaciones y restricciones no arancelarias, así como de los pagos por concepto de trámite por la importación temporal del vehículo y de la garantía de pendiendo del año del vehículo.<p>b) Pérdida total por accidente del vehículo importado temporalmente.<p>1) Copia del aviso presentado ante la Administración General de Auditoría Fiscal Federal, en el cual se define el destino que quiera dar a los restos del vehículo (destrucción o donación a favor del Fisco Federal), en donde conste el sello de que fue recibido por dicha autoridad, en un término no mayor plazo de dos días contados a partir del día siguiente al del accidente.<p>2) Copia de la resolución emitida por la Administración Local Jurídica que corresponda, mediante la cual se autoriza la destrucción o donación del vehículo accidentado.<p>3) Copia certificada del acta de hechos levantada ante la autoridad competente.<p>c) Donación del vehículo importado temporalmente.<p>1) Copia de la resolución emitida por la Administración Local Jurídica, mediante la cual se autoriza la donación del vehículo importado temporalmente.<p>
