permanent resident visa through marriage question

 I am getting ready to move from a tourist visa to one that lets me stay here longer because I am married to a Mexican national. We married here in Mexico and have two kids.

EDIT: Ok, according to the formato I was told to fill out it looks like I am getting a permanent resident visa... about 4 years ago when I looked into this previously, I was told, or under the impression that it would give me permission to remain in the country, but not to work or study. Four years ago, however, we had just married, and I didn't have two years in Mexico. If that makes a difference?

EDIT #2:
Just to clarify... I have been residing in Mexico and married, for more than two years. Does this count to get the permanent residency? Or do have have to first have the visa temporal to start the clock?

As the spouse of a Mexican, you can qualify for Residente Permanente if you have completed 2 previous years on an FM2/FM3 or Temporary Resident visa. See this for more details: Other Categories/Qualifications that Permit a Foreigner to Become a Residente Permanente

It is possible that you qualify as a Residente Permanente due to income or savings. See this for more details: Financial Independence (Savings or Income) Requirements for Permanent Residency / Residente Permanente Applicants

If you have only being living here as a tourist as your post suggests then you have to start the process from scratch and will be temporary for two years and then can apply for permanent residence.

I also did the tramite from a FMM to Residente Temporal in Mexico last Nov. through the Vinculo Familiar law. You also have to have your permission to marry a Mexican National registered with the INM. when you got married in Mexico. I had to have this form that INM had approved and give it to the registrar civil to get married and then I had 30 days to go back to the INM office with the marriage license to have it registered with immigration. If you did all this you will be OK. If you skipped the last step you might have a problem.

Even thought the new SEGOB INM law states you can got to Residente Permanente under the Vinculo Familiar in practice they made me go Residente Temporal for 2 years first.

Even the tramite web page has this option. FMM tramite to Residente Permanente using the Vinculo Familiar law, but when I took the printed form to begin with this they went into the website and changed it to RT for me. No choice.

Great advice, thanks! I had started the paperwork 4 years ago knowing about the 2 year temporary thing. But yes, the requisites only say to have the visa temporal or the tourist, so I was *hoping* despite what Yucalandia said.
I did register the marriage at immigration.. a long, not very funny story about that. I don't have any proof I dont think that I did it though...
Had you resided 2 years prior wo the temp visa? Nonetheless, I will try my luck.

Because you have 2 kids born in Mexico instead of using your marriage you could apply under the Vinculo Familiar law for Residente Permanente from a FMM using this and not have to get on a RT for 2 years using your marriage from a FMM.


No, I did not reside 2 years in a row prior on FMMs but came and went for many years. When married I was offered a FM3 after taking my marriage license back to register at the local INM office here, with financials showing income, but declined.

Yes, the form that I am filling out says "cambio a residente permanente por vinculo familiar". I'll make sure to bring my childrens' birth certificate (though only one of the two was born in Mexico, same father though).
I will update with what they tell me!

INM no longer requires that a foreigner have permission to marry a Mexican. That rule has changed.

How will that impact the Vinculo Familiar rules, etc?

Correct, we got married in March 2013 here in Merida, and INM clearly said they have no desire to be involved in approving or disapproving - saying that we only had to have the Registro Civil's approval. They only asked me to register the marriage with them.

Instead of using your marriage, use your child born in Mexico for the Vinculo Familiar. It's easier, and you are the parent of a Mexican citizen. Take the birth certificate and make it easier on yourself,

You were correct. I went in to INM today and my application to move from a TOURIST visa to a PERMANENT VISA was accepted!
