Moisheh is correct -- an item remains 'new' until it is 6 months old. Georgia is also correct -- it hardly ever matters; enforcement is often rather casual. Unless the item is so obviously new that it can't be overlooked. Yes, take it out of the box, maybe even scuff it up a bit.
