Section 106-Non Owner Driving Foreign Plated Car

We have some confusion again regarding allowing others to drive our foreign plated vehicle here in Mexico. I searched the postings back to 2004 and cannot find the info that I am pretty sure I found here before. We are originally from the US and hold fm3 visas and have a 2 foreign plated vehicles here in Jalisco. We have a friend from Canada with a tourist visa who has used our car with written permission from us and notification to our insurance company Lewis and Lewis. Come to think of it, perhaps they were the ones that told me it was ok for our friend to use the car as long as they had our permission and were not Mexican nationals. Our accountant in PV has just told us that the law does not allow for this and gave us a copy of section 106. I have not cited all of it here, but would be happy to if others would find it useful. For Rolly and others, what is your understanding of the law regarding driving of foreign plated vehicles by foreign, non owners.

Scroll down to Articulo 106, then to IV clause a). Most of us are non-inmigrantes on an FM3 and people on FMM's are also non-inmigrantes. Whether people on FM2's are non-inmigrantes too, I'll leave up to some legal mind. Some are, some aren't.

How it will be seen by the individual official you come up against, I don't know.

I am not a lawyer but I do know for a fact the FM2 holders are inmigrantes. Infact the new card says right on it inmigrante, there are NO FM2 Noninmigrantes..

Casa is correct in his information re: FM 2 status. Mine also says, on the front in the boldest and blackest letters on the whole card "INMIGRANTE". In that case, I would have to agree with Casa.

Hunter, your accountant is wrong.

106 says "...or by a foreigner who has the same immigration category as one of those herein referenced,..."
"those herein referenced" refers to
"a) Las de vehículos propiedad de extranjeros que se internen al país con calidad de inmigrantes rentistas o de no inmigrantes, excepto tratándose de refugiados y asilados políticos, siempre que se trate de un solo vehículo."
Where is says "inmigrantes [FM2] rentistas o de no inmigrantes [FMM and FM3]" Note that it says FM2 rentistas, so I guess other flavors of FM2 cannot drive the car alone.
