RFC and taxes

Can't Post | Private Reply
I have been here as a rentist for almost 5 years (just got my perm), and I've got bank accounts. I never cared about RFC (never dealt with SAT), since my income comes from abroad. However, I just saw a bank statement from one of the banks I have an account with, and it does have a RFC.

As far as I'm concerned, as an expat (rentist - no lucrativa), I don't owe any kind of taxes, or do I?

If you earn interest on a bank or investment account, taxes are taken out and paid to the Mexican government. That's what the RFC is about. YOU do not have to file a tax return, but yes, you are paying taxes on any income, such as interest, from Mexico. Your statement(s) should reflect any interest paid and taxes withheld. This has nothing to do with your immigration status.
Note also that there are not categories of Residente Permanente such as lucrativa or rentista. This is not a change in policy -- it reflects the fact that Residente Permanente is essentially equivalent to the old Inmigrado category. There are different ways of OBTAINING Residente Permanente status, some of which depend on outside income, but not differences in the status itself.

Thanks.

However this is not entirely accurate. Or perhaps not entirely clear, the way you put it.

The INM agent told me my current activity would "stay" as "someone whose source of income is from abroad". So, although the visa itself is PR, the "work status" (or whatever it's called) remains pretty much the same as when I had the FM3 rentista - no lucrativa. At least that was my understanding.

Once you became a Residente Permanente, you entitled to almost all rights and benefits accorded citizens with a few well known exceptions.

I posted a reply in your other thread concerning RFC accounts so I will not repeat it here. http://www.mexconnect.com/...i?post=193741#193741

This article is from the LINEAMIENTOS para trámites y procedimientos migratorios, published in DOF 08/11/2012.

Artículo 60. Las condiciones de estancia que cuentan con permiso de trabajo son las siguientes:
I. Residente temporal cuando se adquiera por oferta de empleo;
II. Residente permanente;
III. Visitante con permiso para realizar actividades remuneradas;
IV. Visitante trabajador fronterizo, y
V. Visitante por razones humanitarias.
Las niñas, niños y adolescentes no cuentan con permiso de trabajo aun cuando sean titulares de alguna de las condiciones de estancia señaladas en las fracciones anteriores.

I opened a savings account at Famsa this year, and I get some interest that shows on monthly statements I receive from them. But so far I have not noticed any taxes withheld, or an RFC number. Is it assigned at the end of the year, or should I start worrying? I have thought about registering with SAT, but my Mexican partner insists it is completely unnecessary, since I get all my income from US.
Thanks, Vic
