Hello-

I have recently moved to Mexico. I work online doing video editing for a major US based company. My checks are issued by a US company and direct-deposited into my US bank account. I subsequently use my debit card for my living expenses here in MX. My husband sometimes does my daily video-editing for me (i gave him 3 hours of personal training and now he edits as well as I). My company does not care who edits the videos as long as they are edited in a timely and quality manner.

my plan is this-

I am issued videos in block form (as many blocks as I want, per week), I am not payed by the hour, though my earnings are approximately 10 per hour. I plan to hire a few locals to edit my videos for me, and pay them 30-50 pesos per hour, which I belive is a fair and good wage considering the minimum wage in my area is a little over 40 pesos per DAY. Also, the work is very easy.

I do not yet have an fm-3, though I am in the process of obtaining one. I do have a valid passport. Can anyone tell me if I will have any legal problems ect, do I need to pay thier taxes, ect, ect?

Anyway, I have a Mexican friend that would like to begin working this week, if possible, as her infant daughter is very ill, and her job as a waitress pays very very poorly. I would love to have her work for me, though I want to make sure that I do violate any laws, ect.

any help in this matter would be greatly appreciated!

You should get a lawyer and consider incorporation which absolves you of of certain hassles. But you do absolutely need an accountant to take care of their and your taxes, their social security, etc. Independent contracting is a foreign concept in Mexico and you have certain obligations as an employer which the account can help you satifsy. You also need to talk to the lawyer about how much work you can do since there are Mexicans who can do the work. Are you on an FM3 or FM2?

Thanks for the advice. There are no "Mexicans that can do the work", or Mexicans that are haveing thier jobs taken away bacause of me. I work online. If my company were to officially expand into Mexico they would probably pay the Mexicans about 6$ per day, since the point of moving ones company to Mexico, and laying off US workers is to save money. I am simply offering a few Mexicans, or Belgians, or Argentinians, or whoever cares to work the opportunity to make a decent wage, and at the same time make ME some money. I am in the process of appying for an fm-3. And Im planning to open my business the legal way:) Also, I dont pay my maid's ss or taxes, and I know my friends dont pay thier maid's either, so are maid's not independant contractors? Thanks

If your are working your maid full time, it is my understanding you would be violating the law. There may be some provision for her to ay her own taxes, but she cannot get social security without, medical insurance, for her family unless she comes up with the whole year's premium. It comes to about $250 a year. I would do that if at all possible and honor the vacation time and other work rule provisions set by the government. That is my opinion.
