Apostilled Birth Certificate

If anyone could please enlighten me regarding this matter, I would be very grateful.

I will imminently be requesting certified, apostilled copies of my birth certificate. However, my original certificate has been lost.
Will this pose some type of problem with the Mexican government? I read somewhere that my original is required.

Also--how many apostilled copies would you suggest I take with me?

I did bring my birth certificate with me, with an apostille attached. I didn't need it to apply for my FM3 or anything else, though one employer did need to see it, so I could be paid, but wasn't interested in the apostille. Just my experience, of course. Others at MexConnect may have different stories to tell...

There is no one government in Mexico ... but rather a bunch of clerks or offices who have varying opinions of what is necessary. The same seems to be for Consulates

I have heard of an apostilled marriage certificates needed on occasion but seldom is a birth certificate needed for anything.

You can always request a new birth cert

I have lived in Mexico for nearly 30 years and have never needed my birth certificate. I have never needed an apostille for any kind of document. YMMV.

When I applied for IMSS, I was asked for my birth certificate with apostille. No other request for it.

You should check with the county or state were you were born to get the papers.

I used to be asked for a birth certificate sometimes when renewing my FM3 visa. Not every year, but if a clerk asked for it, it was a requirement. They didn't need to be apostilled, but they had to be originals with a raised seal on them. I tried using a copy one year but it was rejected because the clerk could not feel the raised seal between his thumb and forefinger.


I used to need to provide an apostilled copy of our marriage certificate every year, it was never returned to me. My attorney told me he would register our marriage with the federal government, and by law, no government agency could keep that certificate, it must be returned to me. I used it for several years when renewing my FM3 and it has been returned to me every time.


I got tired of the bother and extra expense of the INM changing the requirements every year here in Morelos, so I went to a FM2 visa, I won't need to fuss with them for another 5 years now. Oddly enough, no proof of marriage to my Mexican wife was required, They said my nearly expired FM3 visa was all the proof needed. Since I am married to a Mexican citizen, I now need to live here for 2 years with an FM2 to be eligible to apply for Mexican citizenship again. I hope I never see the inside of the INM office again.


Incidentally, an Apostile is a separate document that is permanently attached to another document. If you separate them, they are both void, a Mexican government clerk might not know that though.

A certified birth certificate that you can obtain from your county of birth with the apostille stamp will work just fine...

An apostile is a separate document not simply a stamp. They are issued by the secretary of state for the individual states in the US and are permanently attached to a certified original document. If they are separated, both documents are then void. I have had to request apostilled documents from the secretary of states office in The State of Alaska.


All an apostile does is certify that the person that originally issued a document, or put a seal on it to certify that it was legitimate was authorized to do it at the time it was done. It does not speak as to the legitimacy of the document it is attached to. It is roughly equivalent to a US Notary seal in that respect. A notary seal only states that the notary is satisfied that the person requesting the notary seal has identified them self to the notaries' satisfaction. It does not certify that the document is genuine.


It is my personal opinion that the clerks in most, if not all Mexican government offices do not understand what an apostile is intended for, if they did, they would not ask for them for documents issued in The US.

The apostille stamp goes on a separate page attached to the original document, issued by the secretary of state where the document was issued. They may not understand them Rex but they do require the stamp on many "tramites" you may encounter while in Mexico. The certified birth certificate with an apostille stamp accompanying it on the attached page will certainly suffice for the OP I believe...

Hello all,

Here in Zacatecas over the 20 years I have lived here I have never yet been asked for an apostilled document of any type. I guess we ex-pats are just lucky in this region.

Nevertheless, unlike Sparks, I have been asked for my birth certificate (unapostilled) so many times I have lost count. For example, when I got my first Zacatecas driver's license and every renewal so far. When I opened my bank account. When I matriculated in the University Autónoma de Zacatecas. When I applied for my first FM3. When I applied for permission to buy the lot for my house. Etc., etc. On my FM3 prorrogas (renewals) my Passport now serves instead of the birth certificate. Perhaps if I had had a passport earlier I wouldn't have been asked for the birth certificate. Who knows? I do know that the passport does not work on my driver's license applications. No birth certificate, no new license. A pain in the neck. Why can't they just issue a new one based on the information supplied for the old one? Mexican paper work! Typical here in Mexico.

I think that the difference is in which type of tramite you are involved. Here in Baja for anything involving a federal agency I have been asked for it. Local things like a drivers license they do do not. It probably varies from state to state but I would think that the federal offices would be the same? Maybe not -this is Mexico after all...

If you are going to marry a Mexican national you'll need one... and they'll keep it. If you need an FM2 then youll need to show it to them. So bring 2.

I had to provide a certified copy of my birth certificate once for an FM3 renewal out of 9 renewals. I do not have an original but a certified copy from the city hall from my birth place. It was judged sufficient at that time but who knows the next time may be different.

Thank you for the responses!

I received the certified copies of my birth certificate last week.

Silly inquiry: does it matter if my copies are folded? (With all of the information I have read, I have occasionally stumbled upon some seemingly neurotic requirements!) I must send them to be apostilled and unless I insert them in a bubble mailer with a self-addressed, stamped manila envelope, I will have to place them in a standard envelope. (The latter would actually be much easier for me, as I do not have a vehicle and strongly prefer not to wait until Saturday to visit the post office in order to begin this process.)

Also--how long does it generally take for one to receive these apostilled copies? I am praying that any delays will not extend past two months.

Starcradle, It varys with each state, you can get information online about how long it takes, it also varys as to how you have them sent. Rollys website has some information on this.

I just received my new apostilles too. Took less than a week which is strange. Last time took 2 weeks. So you likely won't have to wait long. I have had it take 3 months on my college degrees but that was a special case. This time it took less than a week on those too.

All of mine were folded.

If you can walk into the secretary of state's office or branch that does apostillation, you can probably get it the same day.We went to the branch in Los Angeles for our marriage certificate and it took 10-20 minutes for them to handle it. I told the clerk it took longer to drive there than to obtain it! However, when I needed to do the same for my birth certificate it took a month to receive it. You would be best to search for your state's vital records web site or secretary of state's web site and it should tell you exactly what the cost will be, what they will want from you: fees,letter indicating which country you want the apostillation for, prepaid envelope,etc. This was for the state of Virginia.

It really depends on the state. I just got a CA document done in less than 2 weeks. In NV, the Sec of State's office told me it will be at least 4 weeks.
