American woman marrying a Mexican man: advice needed

Hey all,

Just a quick question. I'm an American woman and my fiancé is Mexican. We're planning on getting married in Rome, Italy in about a year. I've been told it's a good idea to get the civil marriage license in the States because it will help my husband to travel in and out of the States with me more easily.

I am researching this right now and trying to figure out the requirements, but I'm still not sure about a few things:
1. Is the American civil marriage license really helpful for him?
2. Do we still need to get a Mexico marriage license even if we are getting married abroad?
3. Could we get a civil marriage license in Rome?

I'll have more questions we dig deeper into the organization of all of this, but this is where I'm starting...

Is your fiance currently having difficulty travelling to and from the US ? Why would that be so ?

I can reply to #2. I am married to a Mexican...we got civil m license in USA. We didn't need to get married again in Mexico and I got all working papers I needed. Could apply differently for marrying Italy I suppose. But yes, I often had to show my marriage certificate from USA but for MY visa (not for any thing pertaining to my Mexican citizen hubby).

Ah! This is very helpful! I suppose that makes a lot more sense... since I am going to be living in Mexico, the one who needs to worry about Visa issues is ME, not my fiancé. Okay. Is there any good source of practical information I can access to find out all of these practical requirements for:
1. Getting a marriage license in Mexico OR in the States.
2. Getting a Visa as an American who will be living in Mexico

?

Maybe I am jumping the gun and I just need to read up on it and THEN ask for additional advice. But I don't want to discover at the last minute that I need some obscure paperwork and that all plans must come to a grinding halt until I get it. :o)

First, it is important to note the difference between a marriage license (permission to wed) and a marriage certificate (proving it's done). The marriage certificate is what will be required for various government services in México. If a marriage takes place outside México, the certificate will need to have an apostille attached. Look here for information about that: http://rollybrook.com/apostille.htm. If you marry outside México, you will need to register the marriage when you move to México.

Because of the various paperwork requirements, you may find that it is easiest to marry in México. Because of the apostille requirement, marring in Rome is likely to be a bigger problem than marrying in the USA if your fiancé can come to the USA.

If your husband is employed in México, you may qualify for an immigrant status called alma de casa. You should enter México with a tourist visa (FMT) and apply for the alma de casa at your local INM (immigration) office after you arrive. They will want to see your marriage certificate with its apostille.

First, the immigrant status that Rolly mentions is ama de casa. It simply means 'housewife'.

Second, it is usually more difficult for a foreigner to marry a Mexican IN MEXICO than it is to marry in the States and jump through the hoops Rolly mentions. I was wondering the same thing. He presumably already has a US Visa permitting him to travel into the United States?

On that note, Rolly, I wanted to add that the "ama de casa" FM3 (or FM2) isn't always easy to obtain. Immigration requires documented proof of how the Mexican is going to support the foreigner, a process which requires the Mexican to produce adequate bank and employment records, initially, and every year on renewal. For various reasons, it isn't always the best way to go.

Marlene's right. For many, many foreigners married to Mexicans, it's far easier just to skip the ama de casa option and go for a migration status on their own merits.

In the US you do not need any special permissions to marry a foreign national. Each persdon must present a birth certificate and whatever else the particular state requires. It is a simple process: even illegal aliens can apply for and receive a license to marry in most states with no difficulty. So, you get your license, go to a judge, justice of the peace, or whatever, and have your civil ceremony. You are married. If you want the marriage recognized in Mexico it is a good idea to have the documentation apostilled by the Secretary of State of the state in which you are married, which, again, is a simple matter. See your state's website for inforamtion.
