dual citizenship/Mexican passport

My father was born in Mexico, but lived and owned businesses here in the US since 1950. Although he passed away (also in the US) in 2001, he never exercised his right to obtain US citizenship here. I was born in the US as was my son. We are both US citizens by birth. I, for one, have not tried to obtain dual citizenship, although my research tells me I certainly can do so. My question really relates to my son. He has the opportunity to participate in a world-class sports tournament, but needs a Mexican passport to do so. I saw this as an opportunity for all of us to become closer to our culture and roots (certainly my dad would be elated if he were here). My question is multi-fold:

1) Can my son obtain dual citizenship (or other status as to obtain a Mexican passport) at all, based on the above?

2) If there were any chance for him to obtain one, would this be done via my obtaining dual citizenship based on my father's birth on Mexican soil?

3) If #2 is true, what does that mean if and when my son has children of his own, i.e., can the dual citizenship "filter" through the generations, thus none losing access to their nationality going forward?



I hope someone can give me an informed opinion as time is somewhat becoming of the essence...

A child born abroad of at least one parent who was at the time of birth a Mexican citizen shall acquire Mexican citizenship by origin if by the age of eighteen their parents register the child as a Mexican citizen with the Mexican Consulate. Perchance did your father register you as a Mexican citizen with the Mexican Consulate? (It doesn't sound as if he did, but the question is still worth asking.)


Read, very carefully, the contents of http://portal.sre.gob.mx/...op=page&SubMenu= with regard to nationality.

And finally, there is the route to citizenship under the ancestry category: Direct descendants of a Mexican citizen by birth are eligible for naturalization as Mexican citizens upon completion of two years’ residency in Mexico.

None of these avenues is going to deliver a Mexican passport to your son posthaste.

The Mexican government opened a window in 1998 that permited children of a Mexican parent born in Mexico to obtain Mexican Citizenship. This window closed in March of 2003. I know several Mexican Americans who were born in the U.S. who obtained Mexican Citizenship this way. They in turn were permitted to pass Mexican Citizenship on to their children. There has been speculation that the Mexican government may resume this program in the future. I think your best bet would be to contact the nearest Mexican Consulate and ask them for direction in this matter. I hope this information will be of help to you.
