Registering Marriage License

Hi,

I am married to Mexican National (for 15years and counting) and was wondering if anyone knew if we could register our license at one of the consulates in the US or does this have to be done in Mexico? I was thinking this would be a way to jump start the 2 year timeframe (tied to possibly getting the permanent visa on the fast track :O ) since we were married in US and are considering moving south.

Mexican Consulates will register a birth certificate of a child born to a Mexican but it is not their job to register a marriage with a Mexican citizen, as far as I know.

To register a Marriage License you have to live in Mexico and go to your local Civil Registrars office with all the documents they ask for and then the document they give has your marriage abroad registered in Mexico which the SEGOB INM will need to see and keep a copy of.

Note that sometimes this can be a problem in certain municipalities especially when the marriage was decades ago. It is not a cut and dry thing sometimes.

Bring an apostilled copy of it and possibly apostilled copies of your birth certificate [you might need more later for other agencies here] and you should be OK. Your husband will need a Mexican birth certificate. They might want official Spanish translations.


If you are going for a RP visa at a Mexican Consulate you will need to provide proof of financial solvency. If you are going to apply under "Vinculo Familiar" you do not need financial proof but cannot go to RP until spending 2 years as a RT.

If you apply for "Vinculo Familiar" status the Mexican Consulate might want your marriage license apostilled or not and when going to finalize your RT visa in Mexico the local INM office might or might not want your marriage license registered at your local Civil Registars office.

Thanks for the information...I've done some reading about having to record a US marriage license in Mx. but wasn't sure if anyone had done it at a consulate. Understand on the financial portion, esp. since he has not lived in Mx for so many years, I may have to apply under the standard process.

You should also consider asking about the historical preferences (% approvals) of your local Registro Civil in approving US marriages between Mexicans and US citizens. Our State's Registro Civil has a very low rate of approving them. We waited almost 4 years to be told, "No, we do not approve your US marriage." We appealed to a judge, and were turned down. We know 4 other couples who have had their applications similarly rejected. A current couple we know is currently testing the matter, and after 2(?) years, their application is currently in front of a judge. Because of the likely delays, and because of the possibility of having your marriage rejected, it is good to find out ahead of time whether your Registro Civil regularly approves US marriages, and adjust your plans accordingly.

We had a very nice, small, civil ceremony here in Mexico this spring, fully legal (after 10 years of US marriage), because the Registro Civil confirmed that we were not married in the eyes of the Mexican government. ???

When I went to the consulate in Little Rock a couple weeks ago to get my kids there dual I also asked about getting the marriage cert done and they said "do it in Mexico".

I guess every country is differnt because we had our marriage registered at the French consulate . I know someone who made the mistake of going back to France to do it and he was told to get it from the nearest consultate in the country he was married and lived at the time of his marriage. That was the French consulate so I guess the Mexican consulate does not do it..a little strange, I would double check by calling the consulate /Embassy in Wasington DC.

Interesting...I'll check with Portland and Seattle consolates since it is a toss on which one is closest to our home and from what I heard you can get a different answer from each. Also, we are looking at the Ensenada/Baja area so maybe it is not as big of issue as other areas or maybe we will get married again but in Mx. :-)

I cheked the site of the Mexican Consulate in DC and they have a registro civil in order to register birth, marriages and death but they say that you can register your marriage at the consulate if both spouses are Mexians so if you are no Mexican you probably will have to do whatever they want foreigners marrying a Mexican do.
You still may want to talk to them to know exatly what it is that you will have to do or show.
As you say you can get married here, a good exuse for a nice party!

I told my wife we will just get married again in Mexico also and she said the same thing "we can have a party" LOL

The civil ceremony was quite nice, but the party was even better. The govt. Registrar official made a good heart-warming speech about the beauty, benefits, importance of families, and the importance of marriage between a man and a woman. (As we married in Yucatan, this may have been a swipe at DF's approval of gay marriage?)
