Documentation for flying back to US

Hello...my mother and I want to fly to the US in November. We are going to apply for our FM2 next week which has two steps, being accepted and the actual process. Two questions: (1) Will the government take our passports and FM3's when applying? (2) If they do and we do not receive them back before our trip, can we get in and out of the USA on another type of documentation? Many thanks for your help. Fran

If you apply for your FM-2 next week, and if all of your paperwork is in order, you should have it in your hands by early November. The INAMI time frame is 35 calendar days.

INAMI will not retain your passport. It will retain your FM-3.

There is a procedure for leaving the country while your immigration documents are pending. It's described at INAMI's webste at http://www.inami.gob.mx.

You will need the following:

1. A letter of solicitude, substantially as follows:

Por medio de la presente solicito permiso de salida y regreso cuando el trámite se encuentre pendiente de resolucion. Yo tengo un boleto de avion por GDL a San Diego, California, E.U.A., llegando _______ y regresando a _____ en [date of return]. La necesidad de salir del pais es [reason for trip].

Yo soy declarando, bajo protesta de decir verdad, que no tiene proceso judicial pendiente ni orden de arraigo en contra.

2. Originals and a copy of your plane ticket.

3. Payment of the fees of about $231 M.N. on the SHCP form.

4. The receipt which INAMI gave you when you applied for your renewal or change of migratory status.

The time required by INAMI to process this permission for departure and re-entry is something between 48 hours and one week.

Upon presentation of this application, INAMI will prepare a letter which you will use as a migratory document. You will present this letter to INAMI when you exit the country and again upon your re-entry. You will return this document, with the appropriate stamps showing departure and re-entry, to INAMI within the time specified, usually 5 days after your return.
