Divorced Parent With Child

I am very distressed, as I just found out today, my divorced daughter will not be able to travel to Mexico (at least by land) with my granddaughter without the express written permission of he ex-husband. He hates Mexico and will never write such a "permission" letter. We planned on coming down in March while my granddaughter is on spring break. We do not want to break any laws - does anyone have any advice besides the obvious. Does the permission paper have to be notarized?

It is my understanding that if you fly, this problem does not present itself. Is this the case? We cannot afford for all 3 of us to fly down for only a week. We had wanted to take the bus. Help!!!

The parent consent must be in the form of an affidavit.

A U.S. court order authorizing the travel can substitute for an absent parent who refuses to consent or who cannot be located. If the child has a passport issued in the child's own name, then consents are not necessary. However, the consent of both parents is a necessary prerequisite to obtaining the passport.

Thanks so much for your answer. My daughter plans to get a passport for her child, surely he will not deny the child a passport. His parents live in England.

Glen....evin if they fly, you will still need the written permission of the ex-husband without a passport in her own name.

We found it very easy to obtain permission from the court by writing a letter that contained all the specifics about our trip. We took month long trips with "our" daughter and always mentioned the educational advantages which included the experiencing of another culture and language. Our daughter kept a journal of her trip and upon return, gave a presentation to her clas about the trip. The school was happy, the court liked the whole idea and we got to bypass the biological father who did nothing but hassle us at every turn.
