You are absolutely right gpkisner. It is the refugee system/laws that are lacking and have to be reworked not the tourist visas. This is the fault of the inefficiency of the Canadian government. They should have an adequate refugee system in place that can easily and quickly weed out abusers. However, they havent done that. Instead they are using the tourist visa system to weed out. It's a bandaid. It's something they could do quickly as opposed to doing the real work of fixing the refugee system. It's a typical big government reaction of throwing a wide net without caring about how it affects the fish they arent trying to catch (legitimate tourists).

A Canadian friend of mine currently vacationing in Mexico is married to a Mexican and they have a son. It is ridiculous that he had to go to the Canadian Embassy in Mexico City and wait in line at the last minute just to fly to Canada with his wife and child. They wont even guarantee that he will have his visa in time for his flight.

I think we are beating a dead horse, but Canada's Refugee Program is intended for those who truly need protection, not for just anyone who wants a new life in Canada. I'm not sure how having the program available to legitimate claimants constitutes a "flawed law" or should be considered an open invitation for a free ride by the unscrupulous. In order to find out if a claim is true, it needs to be investigated. Legitimate travellers to Canada will still get visas, just as they do for the USA.

No one is debating Canada's right to institute a visa system for Mexicans.
I believe the major concern, as I tried to express in an earlier post, is that Canada has made it so much more difficult for Mexicans to obtain a visa and visit Canada than it is for Mexicans to obtain a US visa to visit the USA, or Australian visa to visit Australia, or indeed to visit just about anywhere else on the planet.

Hi Tony, I guess it depends where you live in Mexico and who you have to deal with, but for my husband to get his visa for the USA (in order to pass through on the way to Canada) it was no piece of cake. He had to go all the way from Mazatlan to Hermosillo (which is far away - 13 hrs. drive) on two separate occasions, on their schedule. One trip was to apply and one to pick up his visa. He was one of very few who got approved that day and he witnessed many people in tears. The US agents are very hard-line. It cost him a couple of days off work plus overnight motel, a bus fare and a plane fare plus the cost of the visa. He said it was an intense Q & A session and he had to prove all sorts of things to the US official. The Canadians have insinuated that the normal applications can be done my courier service after filling out the forms at home, and no interview is necessary unless they have doubts about your application. This may be where the screening to prevent refugee claims takes place (?)

It is known locally that in order to apply for a work permit in Canada (not a special work program, but a private job) it already takes many months of waiting, plus at least one interview in Mexico City. We know a few who have gone through the process and were denied. For no apparent reason. So to some Mexicans, this new visa process won't seem that difficult. It will be interesting to see how it shakes out after the initial back up of files is cleared through Mexico City. I guess time will tell.

talking about this topic could be an endless conversations and discussion.

Some one said this is good becouse he pays a lot of money importing his car to Mexico and paying fees for whatever, has this guy ever tryied to import, as a Mexican, a car into Canada ?

Has any on here have any idea how many illegal Canucks are working in Cancun and the Riviera Maya area ? have any Mexican has complain about Canadians and Americans taking out their jobs even in their own country ? i just coming back from Playa del Carmen to visit a Canadian friend of mine he proudly told me about the sucess he s experimenting in his business.. he has a illegal status ! and he s using his canadian imported car for his business wich is not allowed !! but... he s white ! he pass like a tourist and he have a lot of Mexican "amigos" whom inconditionally support him becouse he s a "gringo" and he s "nice" !..

I remember one time i called to a real state agency and the man ( an American) ask me if i spoke english becouse he only spoke english. i replied him shame on you American ! you guys complaining in the states becouse Mexicans inmigrants have to speak the lenguage and you here are doing exactly the opposite you are demanding there ?

to the core:

We live in the same street and it is named North America, why are so strangers ? maybe becouse we dont know each others, we have a different cultural background YES ! even Canadians we are differents in Canada ! English and French. ! even english Canadians feel threatened about an American annexation (around 30% ) maybe this misunderstanding and the ignorance about each other makes us so distants ?

there are many angles to see the Canadian decision:

1.- shame ! after the Berlin wall fell when we supposed to live a new era of re-unification and a global world we are building fences !

2.- shame ! becouse it is true ! Mexicans ( they ill be a little more spefic some lines below) are well knowing about being "abusers" !! they abused from a friendly and open arms and "naive" Canadian sistem of refugee !

remark: when we talk about Mexicans it s kinda hard to explain and understant there are many definitions of "Mexicans" and a better understanding of this categories or definitions will help us to better understand the "real Mexico " and the context of many problems.

a.- 15% of Mexicans are white -caucasian european descendants http://es.wikipedia.org/wiki/Demograf%C3%ADa_de_M%C3%A9xico
b.- by consecuence 85 % are not and a huge porcentage are "autochthonous" and the others are a mix of indigenous and spanish descendants.

so even if hollywood represent Mexicans like domestic servants, gardeners and delinquents is very important precise what part of this "society" belongs to.

In Canada and USA was pretty ease to send them,( our first nations) to reserves, or exterminated them ... but here this , indigenous represent more or less 56 millions !! so where in the hell are you going to put and ignore 56 millions of peoples ?

In Mexico everyone is called Mexican, but in Canada is pretty funny hear my friends when they refer to some friend or neighboor or whatever)....... my indian (not from india ...hehe) best friend or my indian neighboor, or a women i met the other day.. and the remark: she s "indigenous".

so we understand when some body say I m Canadian to a white Canadian or a french Canadian to a Quebecois. in the States you label yourself as Caucasian or white american... but a white Mexican never say I m white or Mexican caucasian.

so back to the point, Not all Mexicans are abusers or want to abuse from the Canadian or American goodnes or kidness. not all Mexicans are willing to inmigrate to the promise land ! Becouse 15% of them already did it ! they inmigrated from Europe years ago to a promised land named Mexico ! and many of Canadians, Americans and other nationalities still doing that !

to understand the mentality or ideosyncrasy of this "autochthonous or "mestizos" and the reasons of theirs behaviors are a challenge ! maybe they are abusers as a response of their abusers Spanish conquerors. (another topic)

Agree Mexico is a complex sociaty, their official lenguage is Spanish and they are mostly spanish- indigenous descendants, in the States they speak English and in Canada our official lenguages are English and French............ so... ? are we going to kill each other becouse we are not the same ?


so what s the moral of this story ? why we dont try to understand each other and build a better place to live ?


Less than 40 years ago an Afro-american could not walk in the same place where an with American could do.. ! less than 30 years ago french was not the official lenguage of the Quebecois ! and who judged to the Americans becouse they were not respecting the Afro-american human rights ? NO BODY !!! and now they judge others ?? some cultures and societies are not so fast as others ! so why we dont teach them ???? promote the change ! if you live here you are part of this country even if you retirement monthly cheque comes from the north !

Similar restrictions are now in effect in the European Union. The Czech Republic became an EU member state in 2004, at which time, thousands of Czech Roma, who speak a language similar to Italian, flooded into Italy, setting up Gypsy camps in the big cities. Unfortunately, they were also responsible for a lot of crime in Italy, some of it violent, including murder and rape. Even though they are EU citizens, in 2008, Italy started fingerprinting them and putting other restrictions on them and eventually they started leaving in droves. And it's now apparent that they must have had designs on Canada, a good reason being that if they know Italian, it would be very easy for them to learn French.

Regarding Mexicans. My good friend is a Mexican married to an Italian. He now has an Italian passport and is a citizen of the EU. Last February, his mother and sister came to Italy on their Mexican passports. They were not allowed to transit the USA without a Visa so they took an alternate route to get to Europe. Three months ago, however, my friend was advised that for future visits by his immediate Mexican family, he must write a letter of invitation to the Italian Consulate in Mexico, whereupon his family members will be issued a Visa. No doubt the application for immediate family members will be less complicated than the Visa for Mexicans who have no relatives in Canada, USA or the EU.

Quebec decries visa imposition on Mexicans

MONTREAL - The government of the province of Quebec protested the imposition by Citizenship and Immigration Canada of visas on Mexican citizens.

In a letter sent to the Canadian minister of Immigration, Jason Kenney, Quebecois officials complained of the "negative effects" on their province the visa will have on Mexicans.

The letter dated July 24, was signed by the Quebec minister of Immigration, Yolande James; International Relations, Pierre Arcand; Tourism, Nicole Menard and Inter-government Affairs, Claude Bechard.

The letter, according to agency La Presse Canadienne, states that the Quebec government "is irritated" with Ottawa's decision to slap a visa on Mexicans and Czechs.

The signatories admit that the number of persons requesting asylum does have "a considerable impact on the immigration system" and that Quebec gets 35 percent of the refugees, "more than a fair share".

But, they add, the decision to impose the visa on Mexicans "will have an effect, that cannot be underestimated, on several Quebec sectors that carry on regular trade with Mexico, besides, causing ill feeling with this trade partner in the North American Free Trade Agreement."

Quebec expects to be particularly hard hit in tourism, as "the re-introduction of the obligatory visa in the middle of the summer will effectively demobilize" Mexican tourists.

The letter stresses that "the absence of a visa obligation was a facilitating factor for the arrival of Mexican businessmen and investors."

The provincial government is requesting "immediate emergency measures" to cushion Minister Kenney's decision and, in particular, that there be additional resources in Mexico to "facilitate and speed up visa requests."

They also ask for "a temporary measure" to exempt Mexicans traveling in organized tours from requesting a visa.

There have been virtually no asylum claims from Czech or Mexican nationals in the two weeks since the federal government required them to obtain travel visas before visiting Canada, Immigration Minister Jason Kenney said Wednesday.
On July 13, the Conservative government announced it was imposing the new visa requirement on the two countries because they are the two top sources of refugee claims, many of which turn out to be unwarranted.
In an interview with CTV's Ottawa Bureau Chief Robert Fife before a Conservative caucus meeting in Ottawa, Kenney said Canada has received only one refugee claim from the two countries since a 48-hour grace period ended on July 15.
"I think this is working. It's allowing the legitimate visitors to come and it's screening out the bogus asylum claims," Kenney said during the interview, which was broadcast on CTV News Channel.
According to Immigration Department figures, refugee claims from Mexico have tripled since 2005. More than 9,400 claims were made in 2008 and claims from Mexico were up 50 per cent in the first half of this year, Kenney said.
Since a visa requirement for Czech nationals was lifted in 2007, claims rose to about 3,000 in 2008, compared to five in 2005.
Many of the Czechs seeking asylum in Canada come from the Roma minority, who have long been persecuted throughout Europe.
The new rules require nationals from both countries to apply for a Temporary Resident Visa. The applicants must prove they do not intend to say in Canada past their approved time, they have enough money for their stay and that they are in good health and not a security risk.
"At the end of the day, we had no choice if we wanted to protect the integrity of our asylum and immigration system," Kenney said. "We don't want to have a two-tier immigration system: a really fast one for people who arrive at the airport as false asylum claimants who get a work permit and sometimes welfare benefits, and a longer, much slower system for legal immigrants who come here patiently. That's totally unfair."
Kenney said the government would like to one day lift the visa requirement, but that will require an overhaul of the asylum claim system to make it faster and less susceptible to abuse.
Right now, asylum seekers can have their case heard before the Immigration Refugee Board, but can sometimes wait upwards of 18 months for a decision. If their claim is denied, they can then file an appeal with the federal court, which can cause further delays.
This all means a bogus refugee claimant can spend years in Canada, Kenney said.
Kenney said he is open to suggestions from his parliamentary colleagues about how to streamline the refugee claims process, including a dedicated refugee appeal board.
"If we could streamline the system, make it move a lot faster, a refugee appeal board would make a lot of decisions where you could have a clear appeal and would probably reduce further appeals to the federal court," Kenney said. "But only if we can streamline and speed up the system."

Bingo! Yes, a child born on Mexican territory of foreign parents, regardless of the parents' nationality, is a Mexican by birth.


I thought I read at least one of the parents has to be Mexican.

This is stupid! Of course there aren't any refugee claims. There aren't any Mexicans period ! That is like saying you cured someone's cancer by killing them! Mr. Kenney himself admits in this article that the asylum system needs an overhaul and that this is just a fast and dirty way to deal with it. Typical stupid government.

The entire "Asylum" aspect sounds like smoke and mirrors to me. Czech nationals are citizens of the European Union. All EU citizens are entitled to Visa exempt travel. As of January 2010, however, it's obligatory that they have an electronic passport to enter the USA. But asylum seekers normally do not enjoy visa exempt travel and in most cases, seek asylum after entering a country illegally.
