Can anyone tell me what the law here is concerning bank accounts and what happens in event of the death of the "owner". As an example, both my husband and I have seperate account and I want to know what will happen in the event of either death? Will the surviving spouse have the right to the account? Also, our house is in my husbands name and I am on the title as his wife. Will the house automatically be mine if he should die?

Talk to your bank about their rules. Talk to a lawyer about a will and common law property. Don't seek legal advice from strangers on the internet.

My bank, Santander, requires that a customer name a beneficiary at the time the account is opened. We used my youngest daughter since she spends more time with us than the other kids and her Spanish is fluent.

Bancomer also requires naming a beneficiary.
