They Lie, You Lie!

Chiapas legal advice.

Lying is not bad in Southeastern Mexico. Lying ineffectively is a cardinal sin. By the way, that is also true in the South of France and in many other places as well. Always remember that you are no longer in Racine.

We had some landlord crooks who tried to steal our rental deposit and while we do not know precisely why it appears that that was because these slimeballs had found another renter who would commit to the San Cristóbal apartment for months rather than our two week commitment. They had our 6,000 Peso deposit and when we asked for it back they told us to stuff it while refusing to let us occupy the apartment.

We had no written contract, only an agreement in honor and subsequently here is what we found out:

* No contract and I mean a contract in Spanish in Chiapas spelling out all obligations of both parties in absolute detail - no obligation on either side but, as it happened, they had our money so they could keep our money and we seemed to have no recourse.
* The mere fact that we had deposited $6,000 Pesos in their rental account meant absolutely nothing. Nothing! As the authorities in San Cristóbal told us - how the hell do we know why you put $6,000 in their account?
* E-mail correspondence means nothing in Mexico. E-mail communications are not admissable in court so this thieving woman´s admission that the $6,000 Pesos was a rental deposiot over the internet had no force in law.

When I called them repeatedly and threatened to to sue them for my money they threatened to have a Mexican friend denounce me for threatening them and have me deported.

We went to a local attotney in San Cristóbal and told him that these people were liars and his response to us was:

"They lie, you lie!"

Well, we never had to lie. We told these two thieves who live in both Chiapas and Sonoma County, California that we would report to both the Mexican and U.S. tax authorities that they were tax frauds because we presumed those morons were probably not paying Mexican or U.S. income taxes on their real estate rentals in Mexico and when we did that that $6,000 Pesos was in our bank account so fast we never even saw it pass us on its way there.

Never forget. When you send in a cash deposit for a short term rental in Mexico and the people you send your money to are immoral, if they want to screw you you can kiss your money goodbye unless you are clever enough to scare those worms out of their holes.

Also, never forget the most succinct legal advice we ever got in Mexico by a bona fide Chiapas lawyer:

"They lie, you lie!"

Well, we never had to lie but always remember, Bubba, you ain´t in Dubuque.
