I want to trim her tree

My next door neighbor, with whom I have a great relationship, has a tree, part of which overhangs my pool and is now dropping incredible amounts of leaves into my pool. I would have to be in my pool 24/7 to pick them all out. As a result they are falling to the bottom, decaying and my pool is turning green.

I approached and asked her if she would consider trimming her tree, or better, yet, cutting it down. She understood my situation, offered me some sympathy, but said she had no interest in doing either, as the tree provided her with morning shade.

I guess my question is, what are my options? There is about ten feet of branches that are directly over my pool, but 20feet above it. Do I have the right to have tree trimmers come in and cut those branches back to the property line?. I am spending inordinate amounts of money trying to keep my pool clean, with little success.

I would inform my neighbor of what I am doing. Think it might chill our relationship, but not kill it.


Would like to hear your thoughts. Especially from those who know, not just guessing. Man, is it hot or what? Wow.

Why is it that every aspect of your life seems to require a topic on this forum? What the heck did you do for the first 6 or whatever years you lived there and have you not learned anything?

Clean the leaves daily or weekly from the pool? Trim the part of the tree that is over your property?

While trimming the tree overhanging your property in the US is correct. I would check to see
if Mexican law is the same. Also do you own/rent your property or is it a Condo? If it is a Condo
many times outside land is common to all and controlled by the condo association or whatever.

T if you do decide to cut the branches get a GOOD tree surgeon (word in spanish ???)
and fight the urge to trim the tree yourself unless you know what you are doing with
pruning or you will have a pissed off neighbor. Think this out and involve her in the
project so she isn't blindsided.

Yes, but if you kill or damage the tree you can get in trouble. Complaints, formal disputes, lawsuits and such is how this would be handled in the US. Didn't most of you move to Mexico to get away from that? Work it out with her. Is she also an expat?

What about getting a pool cover? Or paying a local kid a few pesos to pick out the leaves each morning?

I intend to do exactly that. I think she will understand, and as my next door neighbor, do not want to lose her friendship. I will hire someone, as there is no way I can get on a ladder and do tree trimming 20 feet high. T

I realize you are trying to be helpful and thank you. A cover for this pool cost 1,000 USD five years ago and lasted only three years before it disintegrated. Hiring neighborhood kids to come once a day would not work as the amount of leaves entering the pool is amazing. An hour after my gardener left, it was fully one third covered in leaves. I go in twice a day and pick them off by hand. Still not enough. Now that the leaves are falling, there are seeds on her tree that will start falling into the pool soon. They will be even more of a challenge. T

Just trim the damn thing and forget about it. If your neighbor doesn't think enough of you that she/he won't cut it back, then the hell with that neighbor.

I agree with Bennie Barcia. She doesn't want to be a good neighbor knowing that the sh*t from her tree is falling in your pool, so trim it. Here's the name of a good guy who speaks English. Reasonably priced.

I've had the same situation in my last two homes, asked the owner if I could have the tree guys who know what they are doing trim off the part on my property. No problem, the guys are able to get to amazing heights and cut the branches flush with the property line.

I used Luis to trim my neighbor's HUGE tree. He went over and got her permission and hauled off all the mess.

Talked to my attorneys a couple of days ago. Susana Rodriguez to find out what my rights were in this situation, as more than half of my neighbor's tree is over the property line and my pool is now green slime from the falling leaves. It is impossible to keep up with and the chemicals cost a small fortune. Susana told me I had the right to trim the tree to our property line, as long as I did no trimming on my neighbor's side.

I really like my next door neighbor, but she has no interest in trimming that tree, as it provides her shade on her patio in the morning. She lives here part time and spends a few weeks and then back to her home in Texas for a few weeks.

Went over to talk to her a couple of days ago and she is back in Texas, as her car was shrouded. In the meantime, at the peak of the pool season, I cannot use mine, unless I want to slide all over and come out covered in algae.


Is there a bigger problem in the world than mine? Sorry, as I was typing this realized what a stupid problem this is given the overview of the world. Think I will just poison the thing and be done with it. Of course, I have no idea how to poison a tree.

Oh well, and life goes on. T.

I am meeting with my attorneys first part of next week to renew my five year FM3 and discuss this issue up close and personal. I want to do exactly what you are saying, which I know I could do in the states, but I want it clearly defined for me here. There is such a large portion of her tree hanging over my pool, that I doubt it could survive and will have a very pissed off neighbor. However, my pool is now green slime and unuseable at peak season, and I am sp[ending a small fortune for chemicals which cannot keep up with the pace of the leaves falling from her tree. T

All of his posts are all about him. I wish he'd simply do one post listing all of his issuea and problems and get it out of the way. This constant Chinese water torture of one crisis after the other is too much drama. Hopefully one of the mods will put a stop to it soon.
