In a unanimous opinion, the U.S. Court of Appeals for the DC Circuit decided yesterday against EchoStar's challenge to the Federal Communications Commission's "ILLR" methodology by which it is established whether an individual household can receive distant network signals.

The decision comes on the heals of its May ruling in favor of affiliate associations for ABC, CBS, FOX and NBC in a copyright lawsuit filed against the satellite TV provider.

Showing its support for the decision, National Association of Broadcasters (NAB) spokesman Dennis Wharton said in a statement that the organization is "pleased the court unanimously rejected EchoStar's challenge to FCC methodology for determining households that are eligible to receive distant network TV signals.

"This opinion affirms the FCC's hard work and expertise in establishing who is fairly eligible to receive such signals and strengthens broadcasting's rich tradition of localism," he said.

Attempts to reach EchoStar for a comment were unsuccessful at press time.


It looks like the distants will be gone from Dish. This will not affect those of you that have your service address as Chicago, L.A., N.Y., and a few other cities that have their locals on conus transponders, but my guess is that a bunch of you will be losing the US national networks real soon.

It gets worse. If there is no need to broadcast on a CONUS (continental US) or wide beam, DISH could save satellite space and power if those same stations were to be broadcast on spot beams. If you didn't understand what I just wrote, think of it this way. Let us pretend the satellite is broadcasting a light beam. If you wanted to illuminate an area on the earth only a few hundred miles wide, it would take a lot less power than if you had to illuminate the whole Conus. Also that same transponder (channel or frequency) could be used for other spot beams over say five other small areas in the US therefore eliminating the need for five more transponders (channels or frequencies).

I get my local Seattle/Vancouver channels via the Canadian Star Choice delivery system which is not affected by this decision

That's what happened to my much missed NY PBS - it went spot beam. The installer was telling us he feared that a lot more was going to spot beam - we may all be out of luck in the long run. We'd better start stocking up on Star Choice stuff and hope the disease doesn't spread north.

EchoStar Communications is planning to ask the U.S. Supreme Court to protect more than a half-million subscribers from losing access to out-of-market feeds of ABC, NBC, CBS and Fox programming if a private settlement with hundreds of local TV stations can't be reached.

As a result of court setbacks in copyright disputes, EchoStar may have to terminate distant network service to 1.2 million customers in all, including about 600,000 who have been receiving the programming legally. An abrupt cutoff would likely inflict financial pain on EchoStar and generate a strong political backlash on Capitol Hill.

Legal scenarios are expected to play out in three courts as key House lawmakers wait to learn whether thousands of voters are going to lose access to network programming stemming from a court case that has dragged on for years and received little attention.

First, EchoStar Tuesday asked the U.S. Court of Appeals for the 11th Circuit -- which authorized the injunction back in May and just rejected EchoStar’s appeal -- to stay the ruling pending the outcome of the appeal it will file in the Supreme Court.

If the 11th Circuit rejects EchoStar’s stay motion, the case would return to a U.S. District Court in south Florida for processing of the injunction.

Second, in preparation of the stay denial, EchoStar and network-affiliated TV stations that sued EchoStar jointly asked the lower court Tuesday to postpone any injunction until Sept. 11. Both sides informed the court that they were attempting to reach a settlement.

The parties were urged to file for a 45-day postponement by key members of the House Energy and Commerce Committee, including chairman Joe Barton (R-Texas).

Lastly, if the District Court ignores the postponement request, EchoStar still has the option of asking the Supreme Court to lift the injunction while considering the merits of the appeal of the 11th Circuit's May ruling.

In that decision, the 11th Circuit found that EchoStar had flagrantly broken the law by selling out-of-market network signals to thousands of ineligible customers.

I would be surprised if the Supreme Court would hear this case. The best case scenario would be a settlement with heavy fines and a review of accounts with the Distants to determine who is "legal". Worst case would be a total shut down. The NAB has consistently played hardball with Echostar and Dish has consitently thumbed their nose--until now. I don't see a settlement, but I was wrong once before!!!!!!

Well, it didn't take the sonofbitches long. At 5:30 CT Dish-TV has "Technical Difficulties" signs posted on ABC, CBS, NBC and Fox channels. PBS is still OK (thank goodness).

We had the same technical difficulty here in Massachusetts at 6:30 Eastern time from channel 68 on down to channel 2 on DISH.
