Vacation Pay

As it's that time of year, I'm again doing the Alguinaldo and Vacación calculations for our maid and gardener. I think I found a small error on Rolly's go-to web page for these calculations. The website says:

Note: The 6-day minimum vacation is only for the first year worked. The basis increases by 2 days each year through the 4th year. The 5th year it increases 2 days to 15 days. Thereafter, the time increases by 2 days each 5th year.Year 1 -- 6 days
Year 2 -- 6 + 2 = 8 days
Year 3 -- 8 + 2 = 10 days
Year 4 -- 10 + 2 = 12 days
Year 5 -- 12 + 2 = 14 days
Year 10 -- 14 + 2 = 16 days
Year 15 -- 16 + 2 = 18 days
etc


Note how the text says the 5th year increases 2 days to 15 days, but the table shows year 5 as 14 days. I think the text should say "increases 3 days to 15 days" and the table should show 15 days. At least that's what is in his Moving to Mexico book:

Year 15 -- 16 + 3 = 21 days
etc


It's just a small point, but for those relying solely on the web page with employees of 5 years or more, it's worth pointing out the problem.

The book is wrong; my website is correct. Here is a translation of the labor law on vacations;

"Article 76 Workers with more than one year of service shall enjoy annual paid vacations, which in no case shall be less than six working days, and which will increase by two workings days for each subsequent year of service, up to twelve.
After the fourth year, the vacation period shall be increased by two days for each five years of service."

Rolly, I have a question for you. Does alguinaldo and vacation pay have to be paid this time of year? Could it be paid earlier in the year?

Thanks for clarifying Rolly. In that case, that case, the text on your web page "The 5th year it increases 2 days to 15 days." should be changed to say "The 5th year it increases 2 days to 14 days." That was the source of my confusion. And lest I come off as being overly picky, let me thank you again for all you do to keep us informed.

Vacation pay must be paid at the time of the vacation.
Alguinaldo must be paid on or before 30 December. The law does not specify how much before is OK.

I was under the impression that it was to be paid on or before the 20th and that unused vacation was to be paid prior to Dec. 31st.

Law specifies that aguinaldo must be paid on or before 20 December. See paragraph 1 here:

Are they for full time employees only?
What is required, if anything, for someone who does a half day per week? I am guessing nothing, but would like to be sure.

This year I ask my gardener if he got any good deals during "Buen Fin". He told me that he didn't have any extra money during the sale. So it would be legal to pay alguinaldo and vacation pay in November? That way he could use the money at that time and get more bang for the peso.

Just a thought I have.

I like it.
It gives the employee the cash at a time when they can get the most from it.

As with any payment/payout to an employee, create a dated receipt that documents what the payment/payout is for (2014 Aguinaldo), their name, and signature... ??

Good advice. We document each payday and other payments, e.g. vacation, in a ledger bood that the employee signs.

i have a book, i write down hrs worked, date & the payment. my maid will not sign it. i have had this book now for 1 1/2 years. she sees the figures & ok's it verbally. for xmas i have been giving 2 weeks pay. she only works everyother week for 5 1/2 hrs.
