Immigration for spouse of Mexican Citizen

Can't Post |
My husband is a Mexican citizen and our immigration attorney has informed us that his adjustment of status application (and green card) will be most likely be denied at out interview next month. Long story. He will have to return to Mexico while our new application is processed, we're told it will take 1-2 years. I would like to go with him for this waiting period. Is there some other visa besides the tourist visa and FM2 FM3 for the spouse of a Mexican citizen?
I hope so, because I do not speak Spanish (yet) and will most likely not be able to meet the income requirements for the FM visas. Unless they consider a savings account as income. Can someone point me in the right direction?

With a Mexican wife, I am going through the same thing right now.
I called the Embassy here in London and spoke to the Consular Section. Their advice? Go to Mexico on an FM-T and hire a good immigration lawyer for an FM-3 application - it cannot be done outide the country.
Many here have advised keeping a foreign bank account and transferring a good sum every month to a Mexican account as 'proof' of income. An immigration lawyer my wife checked with says that is an excellent idea and usually makes the authorities more lenient towards an FM-3 application.

You can apply for an FM3, but...

an the wife of a Mexican who is economically dependent upon her husband. You can enter on a tourist visa and once your husband has been working for several months, you can go to immigration and request the paperwork. Part of their requirements will be a letter from his boss indicating that he is making enough money to support himself and you.

Suze,
I keep a mimimal amount in a Mexican financial institution and my main income in a U.S. bank. each year (in Chapala) imigracion asks for a print-out of both my Mexican and U.S. accounts for the 3 months prior to my renewal application. A friend who renews in Manzanillo has a german account and a Mexican account and is asked for the same.
Different areas may have differing requirements but if you just park the money you should be okay in most places. Check with others in the area you intend to live to see what the local procedure is. I'll bet you have no problem. The first application should be simple as all they'll ask for (in my case, anyway) is your U.S. (or Canadian) bank reports.
UD
