Mechanic's Liens?

Can't Post | Private Reply
Hello,

This is a great forum! Looking for some advice.
So, I own property in Q. Roo and hired a "contractor" last year to obtain permits. We didn't have a formal contract, just email correspondance. He was not sucessful in obtaining permits, so the building never happened. Last year he mentioned that he spent more than what I wired him (mostly his fees) and said he would eat the differnce. Now 6 months later, he's sending emails demanding the difference - over 50% more than what I've already paid.

It's my understanding that Mexico allows mechanic's liens, so how easy are they to get and enforce. BTW, he didn't do anything with or on the land - it was just professional services.

Does any one have any advice for this type of dispute.

Thanks

Would suggest you speak to a local lawyer in Q. Roo

Rather than hire a lawyer and potentially spend piles more money, I'd take my time, remain calm, and let it ride for the time being. Lawyers (or the courts) here in Mexico don't work with great speed, but their tab keeps growing. It's a shame these things happen, but from what you have said, if you have everything in emails you can at least prove what you agreed to. Good luck with everything.

Just shine the dude on. If you had no contract, he doesn't have a case. Emails are inadmissible as evidence.

Or tell him to account for all of his expenses because you can write them off your taxes or some other such BS and see what he says.

Call his bluff.
