FM3 & Working - (detached from LIVE IN OAXACA?)

I have heard that some people . . . get a job in Mexico that pays lower than the current income requirement. (call center rep, English teacher etc)

If you intend to work here, for example as an English teacher, then you need to apply for the kind of FM3 that gives you permission to do so. This is different from the FM3 rentista that most posters at Mexconnect have.

Yes it is kind of different but it is kind of the same also. That is to say one can get a "FM3 Rentista visa" like what “most posters at Mexconnect have” BUT with permission to perform lucrative activities like teaching or working in a call center.

I could be wrong, but I've never heard of an FM3 that combined rentista status with permission to work. My FM3 says that my status is "no inmigrante con actividad lucrativa" and gives me permission to "prestar servicios como maestra del idioma inglés de manera independiente". I do not have to declare any sort of minimum income I hope to earn each month, but I do have to pay taxes on what income I do earn here. This is in Mexico City, so perhaps things are done differently in other parts of the country.

Hi Isla,

IMHO it is a matter of semantics.

Usually (I hesitate to say always because we all know how things change from one INM office to another.) each foreigner living in Mexico has both a Calidad Migratoria (FM2 Inmigrante or FM3 No Inmigrante or FM2 Inmigrado) and a Característica Migratoria, except for Inmigrados who do not have a Característica Migratoria. (For a list click the link for the other thread at the bottom of my post)

There is not a FM3 Rentista Característica Migratoria. It is called Visitante. All FM3 Rentistas are Vistantes (just like I believe you are a Visitante). When one changes their permitted activities (in order to work) technical they are no longer a Rentista. However they do not change their Característica Migratoria (they are still a Visitante) so they do not change their immigration document.

At least that how it worked for me. I started as FM3 Vistante Rentista and then got a job. I did not change my immigration document, my Calidad Migratoria or my Característica Migratoria but they did add a note in my FM3 book on the annotation page stating that I was allowed to work, thus changing my permitted activities.

I guess that is why I said it is the same type of visa, it is still FM3 No Inmigrante Visitante (but with a change in permitted activities.)

Now that the above is probably as clear as mud; to confuse things there is a FM2 (Inmigrante) Rentista Característica Migratoria. They can be allow to work in certain professions including Professores .

I wrote about all of this in another thread here that might help clear things up. The pertinent immigration law is also cited there.

For me, the difference between being rentista and being able to work is that in the first situation, you have to prove you have a certain minimum income from pensions, investments, etc. With the second, you don't have to prove any minimum income at all, but you do have to pay taxes on the income you bring in from working in Mexico. It can be a very small amount, just a couple of thousand pesos, for example.

Yes exactly, that is true, which takes us back to my post that said "get a job in Mexico that pays lower than the current income requirement. (call center rep, English teacher etc)"

And so it does! And in my case, since I work for myself, the amount I earn is up to me.
