FM3 extensions

It seems there's a new twist to extending FM3s. The assistant in the Guadalajara office told me I had to have two witnesses sign a form stating that I am providing economic and moral support to my wife. The written instructions (in extremely bad English) indicate that this is required only for spouses married to Mexican citizens, but I guess those instructions haven't been updated yet.
If anyone happens to have a copy of the form on hand could you help me with the first paragraph?

the second paragraph states: Asimismo hago constar que yo, el Sr Kim Metzger de nacionalidad norte americano doy todo mi apoyo moral y economico a Sra. Metzger de nacionalidad alemana.

But the first paragraph seems to require the same names and citizenships or do I enter the names of the witnesses there?
1. Los suscriben ..... de nacionalidad ..... y ...... de nacionalidad .... declaramos bajo protesta de decir verdad que susiste hasta la fecha nuestro vinculo.....

The second paragraph reads in English: Also I swear under oath that I, Mr. Metzger of United States nationality give all my moral and economic support to Mrs. Metzger of German nationality.

When filled out it will read in English: Those who sign Kim Metzger of United States [estadounidense] nationality and XXX Metzger of German (alemana) nationality declare under oath to the truth that our union continues until the present date.

Somewhere else on the document should be space for the two witnesses (TESTIGOS) to sign and date.

Better check with Immigration whether they want all four of you to fill out that form and sign it in their presence, or it if must be notarized, or if ---lucky you--- you can just fill it out and submit with your other papers.

It is not a new twist: it is what you nee to have when your wife has applied for the FM3 as your dependent. If she wants to have her own FM3 she will need to pay a fee to change her status.
They have not required for the form to be notarized in the past in Guadalajara but require a copy of an ID for the two witnesses.

It seems strange that they would be asking for proof of income to support your spouse on an FM3 renewal, with witnesses, unless your wife entered México on a tourist, or similar visa and this is the first time you have been asked to prove extra income to cover your spouse.


Many years ago I got my first FM3 visa at The Mexican Consulate in Phoenix, Arizona. At that time, I was asked to prove that I had 50% more income than I needed to qualify for an FM3 visa for myself to show proof of the ability to support my spouse, even though my wife is a Mexican citizen. I was not asked to provide any witnesses at that time. Maybe The Consulate had some people sign as witnesses without my realizing it though.


Every year I must prove 50% more income than I need to qualify for my FM3 renewal to show that I can support my Mexican wife, I am never asked to provide any witnesses, or fill out any special forms here in Cuernavaca, Morelos. As a Mexican citizen, my wife is not required to have any type of a visa to live in her own country.


It did seem strange to me at first that I would need to prove more income for my wife to live in her own country. Upon reflection, I now realize that in The US, if a man refuses to support his wife, she will have legal recourse in court to receive support payments. In this country, that type of legal protection will not always be provided for every spouse.


You might want to consider hiring a lawyer or facilitator for this first renewal and to get a FM3 visa for your wife, if she does not already have one. It really sounds to me like the person at immigration that has told you what you need to do, does not know their job duties very well, not unusual in Mexican government offices.

We have been doing these forms for the last 9 years 4 on FM3 and 5 on FM2 . No need for lawyers or facilitators, I have asked for a change and the Guadalajara office told me to apply for a change of status on the form we fill every year (at the back) . There is a separate fee for it so I never bothered. I was also advised to do it at a different time than at renewal time to expedite the process .

I have two friends to witness, they give me a copy of their voters´registration and that is it.
This year I asked two American friends to do it with copy of their passports. Not a big deal, I will change it this year before becoming inmigrado.
The funny part in this is that we applied at the me time, the only thing I can figure is that at the time we applied with a Lloyd Statement to prove the income, we had a joint account but only my husband name showed on the statement so they took that as proof that is was the breadwinner and that I did not have an other souce of income.
