Investment regulations in Mexico

New foreign investment regulations establish conditions under which --with strict adherence to the law-- foreign investors may legally participate as major stockholders with new investments in sections where no limit is expressed.*

Investors need to register the new investments and comply with the following conditions:

  1. Total investment may not exceed 100 million dollars.
  2. Capital for proposed investment must be generated outside Mexico.
  3. Proposed investment must be made outside of those zones considered overcrowded by existing industry (metropolitan areas in Mexico City, Guadalajara and Monterrey).
  4. The investors must maintain an equilibrium in capital balance for the first three years.
  5. The investor must generate permanent employment and participate in training and development programs for employees.
  6. The investor must agree to utilize adequate technologies and observe environmental protection regulations.

Foreigners looking forward to investing or starting a business in Mexico are required to get a business visa from this Consulate General of Mexico to enter the country. Once in Mexico, they must observe the local regulations concerning incorporation of their business.

The establishment of a business in Mexico does not automatically allow the foreigner to live permanently in Mexico or to work there. Thus, he or she will require a special permit from the ministry of the interior (Secretaría de Gobernación)in order to live or work in Mexico.

*Limited or restricted activities include petroleum other hydrocarbons, basic petrochemicals, exploration of radioactive minerals and the generation of Nuclear Energy. Mining, electricity, railroads, telegraphic and wireless communications, and other activities established by specific laws.
